By acquiring any of the services available on the Virtual Campus and completing the registration process, the User expressly and unreservedly accepts the present Contracting Conditions, as well as those set out in the Privacy Policy.
The User declares that he/she has the necessary legal capacity to contract and be bound by them in accordance with the law.
The School does not offer services to minors. Services and products intended for minors must be purchased exclusively by their parents or legal guardians. Minors under the age of 18 may only use the Website under the supervision of a legally responsible adult.
Purchase process, returns and refunds
In order to place an order, it is necessary to have an identification code and a password that the User must generate by filling in a registration form, with the possibility of subsequent modification. If the User has already registered previously, he/she will be able to make subsequent purchases using the username and password created in the first purchase.
The access credentials are personal and non-transferable and correspond exclusively to the person who made the registration. It is forbidden to place orders using the credentials of third parties without their express authorisation.
Before formalising any purchase it will be necessary to tick the checkboxes relating to the reading and acceptance of these Conditions of Contract and the Privacy Policy.
Prices and payments
The User agrees to pay Colegio Internacional San Francisco de Paula the amounts indicated at the time of purchase in consideration for the services purchased. The prices published on the Website include the corresponding VAT.
The Website provides updated information on the availability of each service on its specific page. It is not possible to provide more information than that shown in these sections. In the event that, when processing the order, any service is not available, the User will be informed by email as soon as possible and no charge will be made for this item.
Payment for services may be made by debit or credit card, through an immediate, secure and verified payment system. All transactions are validated by the corresponding bank and, once accepted, are processed automatically and instantaneously.
Colegio Internacional San Francisco de Paula does not have access at any time to the User's bank details. All available payment methods comply with the required security measures. The contract shall be deemed to be completed at the time the payment is made.
The School reserves the right to temporarily or definitively suspend the contracted services in the event of any incidents in the payment process.
The invoice corresponding to the purchase will be sent by e-mail to the User, who will be responsible for verifying its receipt and for communicating any modification in his or her data. The College shall be exonerated from liability for errors arising from the failure to update this information.
Right of withdrawal
You have the right to withdraw from this contract within a period of fourteen (14) calendar days from the date of conclusion of the contract without the need for justification in accordance with article 102 et seq. of the Real Decreto Legislativo 1/2007, of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users and other complementary laws.
To exercise your right of withdrawal, you must notify Colegio Internacional San Francisco de Paula, Calle Alcázares 8, Postcode 41003, Seville (Spain), email: administración@sfpaula.com, of your decision to withdraw from the contract by means of an unequivocal statement.
In the event of cancellation, any payments received will be refunded within a maximum of fourteen (14) calendar days of notification.
Payments made in respect of tuition fees, enrolment fees, place reservations or any other payments linked to the provision of formal or informal educational services by the pupils’ legal representatives are expressly excluded from the scope of the right of withdrawal.
This is due to the fact that these payments correspond to services of an educational nature, the execution of which begins from the moment in which the entity in charge makes available to the student the organisational, teaching and material means necessary for the development of the training activity, which determines that the right of withdrawal provided for in articles 102 and following of Real Decreto Legislativo 1/2007, de 16 de noviembre does not apply, as these are services whose correct provision requires planning and advance availability of resources and, where appropriate, services already partially executed with the consent of the consumer.
Consequently, the amounts paid in respect of these items are non-refundable, without prejudice to the mandatory grounds for termination of the contract provided for in the applicable regulations or in the cases expressly set out in the relevant contract for the provision of educational services.
Obligations of the parties
The User undertakes to use the services in good faith, respecting current legislation and the rights of third parties, as well as to pay the price of the service in accordance with the provisions of these Conditions.
The School does not guarantee the uninterrupted availability of the service, which may be affected by incidents on the Internet, failures in computer equipment or other unforeseeable circumstances. The User accepts these possible limitations and expressly waives any liability claims against the College for failures, errors or interruptions in the use of the contracted service.
Modifications
Colegio Internacional de Sevilla - San Francisco de Paula reserves the right to modify the characteristics and conditions of its services, in search of continuous improvement and offering a better user experience for the User.
Divisibility
If any of these Terms and Conditions is deemed invalid, void or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of the remaining conditions.
Privacy and processing of personal data
When it is necessary to provide personal data in order to access certain content or services, the User guarantees their truthfulness, accuracy, authenticity and validity. The User may access the policy followed in the processing of personal data, as well as the establishment of the purposes previously established, under the conditions defined in the Privacy Policy.
Applicable law and jurisdiction
This contract shall be governed and interpreted in accordance with Spanish law.
In the event of any discrepancy or difference between the parties in relation to the interpretation, content or execution of these conditions that is not resolved by mutual agreement, the parties shall submit to the courts or tribunals that are competent in each case, provided that the user is a consumer.
In cases where it is provided that the parties may submit to a freely chosen jurisdiction, they will submit to the Courts and Tribunals of the city of Seville (Spain), expressly waiving any other that may correspond to them.
